- Service Description
Bizmail offers subscription-based services for email mailbox setup, management, and domain services, including:
- Google Workspace Setup: Provision and management of Google Workspace mailboxes.
- Microsoft Outlook 365 Setup: Provision and management of Microsoft Outlook 365 mailboxes.
- DNS Management: Configuration and maintenance of DNS records including DKIM, SPF, and DMARC.
- Domain Services: Assistance with domain registration, transfers, and renewals.
Please note that Bizmail acts as a reseller of services from various providers and cannot guarantee the functionality or outcomes of third-party services.
- User Obligations
- 3.1 Account Setup: Users must provide accurate and complete information when creating their accounts and maintain the confidentiality of their credentials.
- 3.2 Business Operations & Address Verification: Users are responsible for adhering to all relevant laws, including data protection laws (GDPR) and anti-spam regulations (CAN-SPAM Act).
- 3.3 Prohibited Activities: Users must refrain from activities such as:
- Sending unsolicited bulk emails (spam).
- Using the service for illegal activities or fraud.
- Interfering with or disrupting the integrity of Bizmail’s services.
- Introducing viruses or harmful software.
Failure to comply with these obligations may result in suspension or termination of services.
- Payment Terms
- 4.1 Fees: Service fees are billed monthly in advance and are non-refundable under any circumstances, even for non-usage or cancellation during the billing period.
- 4.2 Subscription Renewal and Cancellation: Subscriptions renew automatically on a monthly basis. Users may cancel their subscription at any time via the dashboard, with cancellation effective at the end of the current billing period.
- 4.3 Refund Policy: All payments are non-refundable, including circumstances involving non-usage or dissatisfaction.
- Intellectual Property
- 5.1 License Grant: Bizmail grants users a limited, non-exclusive, and non-transferable license to use its services for business purposes.
- 5.2 Ownership: All intellectual property rights to Bizmail services, content, and software are owned by Bizmail. Trademarks mentioned in relation to third-party providers are the property of their respective owners.
- Indemnification
Users agree to indemnify, defend, and hold harmless Bizmail, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, losses, damages, expenses, or costs (including legal fees) arising out of or related to:
- The user's breach of these Terms and Conditions.
- The user's use or misuse of Bizmail services, including but not
limited to email management, domain services, and third-party
integrations.
- Any violation of applicable laws, including but not limited to data protection laws and anti-spam regulations.
- Any data loss, business interruption, or harm resulting from the use of Bizmail services or third-party services integrated with Bizmail.
- Termination
- 7.1 Termination by Bizmai: Bizmail reserves the right to terminate user accounts if terms are violated, or for any other reasonable cause.
- 7.2 Termination by User: Users may terminate their subscription at any time via their account, with service cessation at the end of the billing cycle.
- Disclaimer of Warranties
Bizmail provides services on an "as-is" and "as-available" basis
without any warranties of any kind, whether express, implied, or
statutory. This includes, but is not limited to, implied warranties
of merchantability, fitness for a particular purpose, or
non-infringement.
- Limitation of Liability
Bizmail is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or business interruption. Users agree that Bizmail is not responsible for any outcomes related to the suspension or health of their email accounts or services purchased.
- Data Protection
- 10.1 Use of Data: Bizmail collects and processes personal data in line with its Privacy Policy and adheres to GDPR and other applicable data protection laws.
- 10.2 User Responsibility:Users must ensure that they have proper consent to share any third-party data with Bizmail.
- Anti-Spam and Compliance
- 11.1 Compliance with Anti-Spam Laws: Users must comply with anti-spam laws such as the CAN-SPAM Act and GDPR. This includes obtaining the proper consent from email recipients and providing an opt-out mechanism.
- 11.2 Prohibition of Unsolicited Emails: Users may not send unsolicited bulk emails using Bizmail services.
- Security Measures
Bizmail employs various security measures to protect users' data,
including encryption and regular security audits. However, users are
responsible for securing their own accounts by using strong
passwords and safeguarding their login credentials.
- Third-Party Service Providers
Bizmail may partner with third-party service providers to enhance its services. These providers include, but are not limited to, analytics tools, hosting providers, and payment processors. Third parties are contractually obligated to use your data only to perform services on behalf of Bizmail.
- Data Breach Response
In the event of a data breach, Bizmail will promptly notify affected users and relevant authorities and take necessary steps to mitigate the impact.
